RE:          Agenda Item #11 – The Reserve at Anunson Creek – S. of 2158 Irish Rd. (0080199 & 0080201) – Proposed 64-Lot Subdivision

Overview

The applicant is proposing a 64-lot subdivision plat on 25.290 acres.  The property was incorporated into the Sewer Service Area in September of 2004, zoned R-2 Suburban Residential in October, then was divided by CSM in December and a revised CSM approved in February of 2005.  However, the CSM has not been recorded.  The plat will have an average lot size of 11,898 square feet with a typical lot size of 85 feet by 140 feet; both of which meet the requirements of the County Subdivision Ordinance Chapter 18. 

Findings of Fact

1.       This proposal is consistent with the Low Density Residential designation in the 2003 Town’s Comp Plan.

2.       This proposal is compliant with County/Town Zoning Ordinance Chapter 17-05 R-2 Suburban Residential Dist.

3.       The proposal is compliant with County Subdivision Ordinance Chapter 18.

4.       This proposal compliant with Town’s Municipal Code Chapter 6.

5.       The proposal is compliant with Town’s Municipal Code Chapter 31.

6.       This proposal is compliant with State Statues 236.

7.       This proposal is not compliant with the International Fire Code.

8.       The Park Commission recommended 3 acres of active parkland and 1.36 acres of credit for the trail contained on the west property line of the proposed future phases of the development. 

 

Staff Recommendation

Staff recommends conditional approval of the proposed 64-lot preliminary plat proposed by Dev. Mark Winter located south of 2158 Irish Road also known as parcel number 00800201 and 0080194 for the following reasons:

1.       Per the International Fire Code D107.1: “Developments of one or two-family dwellings where the number of dwelling units exceeds 30 shall be provided with separate and approved fire apparatus access roads, and shall meet the requirements of Section D104.3.”  D104.3 states, “Where two access roads are required they shall be placed a distance apart equal to not less than one half of the length of the maximum overall diagonal dimension of the property or area to be served, measured in a straight line between accesses.”  A second access is required 750 feet from the Wasilla Lane access and shall be shown on a preliminary plat that conforms to the requirements of the International Fire Code.

2.       The CSM approved by Resolution #050228-3 shall be recorded.

3.       A Developer’s Agreement between the Town of Menasha and the applicant shall be drafted and accepted by both parties. 

4.       A Stormwater Management and Erosion Control Plan along with appropriate fees shall be filed with the Community Development Department. 

5.       The Park Commission recommended 3 acres of active parkland and 1.36 acres of credit for the trail contained on the west property line of proposed future phases of the development.  Until such time as development of future phases, a separate escrow account totaling $22,050 shall be established.  Fifty percent of this amount will be due at the time of final plat for The Reserve at Anunson Creek.  The remaining fifty percent shall be due upon sale of fifty percent of the lots within The Reserve at Anunson Creek.  Said escrow shall revert to the Town should development of the future phases not be platted and recorded at Winnebago County via final subdivision plat within three (3) years of the date of approval of this preliminary plat.

6.       The applicant shall provide a drainage easement of not less than 30 feet in width for the purposes of access by the Town of Menasha to the retention pond proposed on Outlot 1.
