This certified survey map (CSM) will create 3-lots and dedicate right-of-way for Irish Road and E. Shady Lane.  The house is located on Lot 1 and the barn is located on Lot 3. 

Lot 1 - .311 acres (13,543 sq. ft.), Lot 2 – .637 acres (27,728 sq. ft.), Lot 3 – 12.235 acres (532,971 sq. ft.)

As proposed, the CSM does not comply with Winnebago County Land Division Ordinance Chapter 18 regarding lot sizes.  Chapter 18 states that lots zoned A-2 shall be at least 5-acres in area.  Lots 1 & 2 are less than 5-acres. 

In addition, staff would like to see Lot 3 maintain a 60-foot access to Irish Road for future development purposes.

Findings of Fact

Staff finds that this CSM complies with the Town of Menasha’s Chapter 6 Subdivision Control/Planned Unit Development Ordinance.

Staff finds that this CSM complies with the Wisconsin State Statutes Chapter 236.

Staff Recommendation                            

Staff recommends approval of this CSM with the following conditions:

·         Lots 1 & 2 shall be rezoned to comply with the Winnebago County/Town Zoning Ordinance Chapter 17 & 18.

·         Staff feels that it is important to advise the applicant, that this CSM may limit the options for the development of Lot 3 in the future.
