This certified survey map (CSM) will create 2-lots and dedicate right-of-way for Airport Road. 

Lot 1 – 1.1060 acres (48,177 sq. ft.), Lot 2 – 1.2448 acres (54,224 sq. ft.)

Staff feels that the proposed CSM will compound the problems of the existing development in this area.  Staff is recommending that the developer meet with staff to explore other options for the development of parcel number 008-0353-05 and the adjacent parcel number 008-0353-09 which are owned by the applicant. The adjacent parcel has 5 single family homes on one lot.  The homes are non-conforming and appear from the exterior to be substandard. 

Findings of Fact

Town of Menasha’s Chapter 6 Subdivision Control/Planned Unit Development Ordinance requires that the developer consult with the Planning Commission prior to the creation of a subdivision and the developer has not completed that consultation.   

Staff also finds that that the creation of this CSM as submitted may not meet the purpose of Chapter 6 Subdivision Control/Planned Unit Development Ordinance which states that it is “to promote the public health, safety and general welfare within the Town of Menasha to lessen congestion in the streets and highways; to further the orderly layout and use of land; to secure safety from fire, panic and other dangers; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate adequate provision for transportation, water, sewerage, schools, parks, playgrounds and other public requirements; and to facilitate the further re-subdivision of larger tracts into smaller parcels of land.  The provisions of this ordinance are made with reasonable consideration, among other things, of the character of the Town with a view of conserving the value of the buildings placed upon the land providing the best possible environment for human habitation and encouraging the most appropriate use of land throughout the Town.

Staff Recommendation                            

Staff recommends delaying the approval of this CSM for 30 days so that the developer can have further discussions with staff on alternatives for this CSM.
