RE:          Agenda Item 2 – Preliminary Plat – Airport Grove – 008-0353-05 & 008-0353-09

Overview

The applicant is proposing a 10-lot subdivision called Airport Grove for the property at 829 & 833 Airport Road, 008-0350-05 & 008-0353-09.  The total area of the subdivision is approximately 3.8-acres with an average lot size of 12,521 square feet.  The applicant is proposing a new 60-foot street right-of-way with a cul-de-sac.  All existing structures on the property are proposed to be razed.  The property is currently zoned R-1 (Rural Residential). 

 

The applicant is also requesting a zoning change to R-3 (Two-Family Residential), Item 3 of this agenda, for a duplex subdivision.  The Future Land Use Map identifies this area as low-density residential, 5-units per acre or less.  A 20-unit, 10-lot subdivision would have a density of 5.26-units per acre, exceeding the low-density designation.

 

The Park Commission at their January 11, 2006 meeting recommended fees in lieu of parkland dedication.

Findings of Fact

·         Staff finds that this Preliminary Plat does not comply with the Town of Menasha’s Chapter 6 Subdivision Control/Planned Unit Development Ordinance.

o        Stormwater Control is not indicated.

o        Easements are not identified.

·         Staff finds that this Preliminary Plat does not comply with the Town of Menasha’s Chapter 30 Comprehensive Plan Ordinance Future Land Use Map in regards to density.

Staff Recommendation                            

Staff recommends a 30-day delay of this Preliminary Plat so the Developer can address the following conditions.

·         All street dedications shall be identified on the plat as dedicated to the public.

·         The number of units shall be indicated on the Plat to verify the density of the subdivision to comply with the low-density residential designation on the Future Land Use Map.

·         The applicant shall meet all the requirements of the Town of Menasha Municipal Code Chapter 6.

·         More detail shall be provided for stormwater control.

 

Should the above be resolved, at the time of final plat the applicant shall be required to adhere to the following conditions?

·         The Park Commission recommendation that fees in lieu of parkland dedication shall be accepted for this Subdivision.

·         A Developer’s Agreement between the Town of Menasha and the applicant shall be drafted and accepted by both parties.

·         A Stormwater Management and Erosion Control Plan along with appropriate fees shall be filed with the Department of Community Development.

·         Utility and drainage easements adequate to serve the development shall be provided according to Town of Menasha Municipal Code 6.22 (3).

·         The applicant shall provide a drainage easement, not less than 30-feet in width, to provide access to the proposed detention pond(s) by the Town of Menasha.
