RE:          Agenda Item 2 – Certified Survey Map – Portside Builders


The applicant has submitted a Certified Survey Map (CSM) for the property located at 980 American Drive (008-4812-02).  The original application for the CSM was withdrawn at the Town Board level.  The application is for a 3-lot CSM with Lot 1 used for the storm water pond, Lot 2 is the retail center and Lot 3 is Portside Builders.  One issue, which was overlooked in the original submittal, is that the storm water pond is its own parcel.  As the pond is shared between Portside Builders, the HJ Martin building, the horseshoe building, and the warehouse north of Jameson Street, a deed restriction should be place on Lot 1 so that it shall only be used for storm water management.

Findings of Fact

·         Staff finds that this CSM complies with the Town of Menasha’s Chapter 6 Land Division Ordinance.

·         Staff finds that this CSM complies with Winnebago County Town/County Zoning Ordinance.

Staff Recommendation                            

Staff recommends approval of this Certified Survey Map with the following conditions:

·         All taxes and assessments shall be paid prior to the Town affixing signatures on the Certified Survey Map. Final Plat.

·         A deed restriction shall be placed upon Lot 1 that states that the Lot shall only be used for storm water detention.
