MINUTES


Agendas with resolutions were posted at the Municipal Complex, Fire Station 40, Sanitary District No. 4, Appleton Public Library, Menasha Public Library, and Neenah Public Library.

CALL TO ORDER, PLEDGE OF ALLEGIANCE AND ROLL CALL

Town Chair Arden Tews called the regular meeting of the Town Board of Supervisors to order at 6:00 p.m. and led the Pledge of Allegiance.

II. AWARDS/PRESENTATIONS

A. Award; GRATE – Governmental Reporting Awards Through Evaluation – Presented by: James Villiesse, Administrative Secretary

James Villiesse, Administrative Secretary of GRATE (Governmental Reporting Awards Through Evaluation), presented the Town of

Menasha with a Certificate of Commendation for the year ended December 31, 1997.

Congratulations to the Town of Menasha Finance Department in achieving this award. The Town of Menasha is only the second Town in the State to receive this award.

 

PUBLIC FORUM – NON-AGENDIZED TOWN RELATED MATTERS

Joe Trudell, Town Resident, questioned if the final payment to P.G. Miron was made.

The Town Board responded that yes, it was paid in December of 1997.

 

DISCUSSION ITEMS

Agreement – Town of Menasha/WI Department of Transportation – USH 10/USH 41/STH 441 Interchange

Administrator Vitas provided an overview to the Town Board and Residents regarding what this project would involve.

Chairman Tews stated that when the project begins, he is hoping the Town will be allowed to have input.

Supervisor Krueger requested a map showing how this would look.

Administrator Vitas replied that the maps are not yet available.

 

OLD BUSINESS

990208-5: TMPPA Union Contract – Side Bar Agreement

Supervisor Krueger questioned why this was being added at this time.

Administrator Vitas replied that it was at the request of the Police Department.

MOTION: Supervisor Sprague, second Supervisor Jurgensen to approve the attached TMPPA Union Contract – Side Bar Agreement, retroactive to January 1, 1999. Motion carried with a vote of 4-1. Sprague, Jurgensen, Nennig, and Tews voted YES. Krueger voted NO.

 

NEW BUSINESS

A. 990222-1: Rezoning – St. Mary High School, South of Zephyr Drive (008-4811p) & (008-4815p)

MOTION: Supervisor Krueger, second Supervisor Sprague to approve the resolution for rezoning.

MOTION: Supervisor Sprague, second Supervisor Jurgensen to amend the resolution to eliminate the reference to Lot 1. Motion carried unanimously.

MOTION: Supervisor Krueger, second Supervisor Sprague to approve the resolution as amended. Motion carried unanimously.

990222-2: Certified Survey Map – Jeff Ogden w/ St. Mary High School (008-4793, 008-4811, 008-4816, 008-4812, and 008-4814)

MOTION: Supervisor Krueger, second Supervisor Jurgensen to approve the Certified Survey Map with the condition that it be revised to show existing dedicated roads. Motion carried unanimously.

C. 990222-3: Certified Survey Map – Craig Kisser, off of County BB (008-0147-01)

MOTION: Supervisor Sprague, second Supervisor Krueger to approve the certified survey map. Motion carried unanimously.

D. 990222-4: Certified Survey Map – Pat Gambsky, 120 Riverview Court (008-1069, 008-1070)

MOTION: Supervisor Krueger, second Supervisor Nennig to approve the certified survey map. Motion carried unanimously.

990222-5: Amendment to the B-4/B-5 Town/County Zoning Ordinances

MOTION: Supervisor Krueger, second Supervisor Nennig to approve the amendment to the B-4/B-5 Town/County Zoning Ordinances, which will allow an entire building to be metal only when the bottom portion of the building that would be of some other allowed material is screened from view of all adjacent properties and public rights of ways and this screening shall consist of a berm or solid fence of adequate height to screen the lower 1/3 or 7 feet of the building from view from adjacent properties or public right of way. Motion carried unanimously.

F. 990222-6: Agreement – Wisconsin Nuisance Wildlife Control LLP

MOTION: Supervisor Sprague, second Supervisor Jurgensen to approve the Agreement between the Town of Menasha and Wisconsin Nuisance Wildlife Control LLP, effective the 1st of March, 1999 and will expire the 31st day of December, 1999. Motion carried unanimously.

G. 990222-7: Personnel Policy Amendment – Chapter 20, Holidays for Police Lieutenants

MOTION: Supervisor Sprague, second Supervisor Jurgensen to approve the change in Chapter 20 of the Personnel Policy, effective immediately. Motion carried unanimously.

H. 990222-8: Personnel Policy Amendment – Chapter 5, Scheduled Hours, Overtime and Compensatory Time (Police Lieutenants)

MOTION: Supervisor Sprague, second Supervisor Nennig to approve the change in Chapter 5 of the Personnel Policy, effective immediately. Motion carried unanimously.

I. 990222-9: Personnel Policy Amendment – Chapter 23, Fringe Benefits (Eligibility Dental/Medical Benefits)

MOTION: Supervisor Jurgensen, second Supervisor Sprague to approve the amended Chapter 23 of the Town’s Personnel Policy, eliminating the medical/dental benefits for employees working less than thirty (30) hours per week, retroactive January 1, 1999, with those employees working less than thirty (30) hours per week enrolled prior to January 1, 1999 will remain eligible for coverage under the Town’s medical and/or dental benefits. Motion carried unanimously.

J. 990222-10: Additional New Chapter Personnel Policy Manual – Chapter 31 Workplace Violence

MOTION: Supervisor Sprague, second Supervisor Jurgensen to approve the addition of Chapter 31 to the Personnel Policy Manual, effective immediately. Motion carried by a vote of 3-2. Jurgensen, Nennig, and Tews voted YES. Krueger and Sprague voted NO.

K. 990222-11: Individual Amusement License – Gun Show at Sabre Lanes

MOTION: Supervisor Jurgensen, second Supervisor Nennig to grant an Individual Amusement License to Jeff Phelps of Fox Valley Muzzle Loaders for a Gun Show at Sabre Lanes Friday, March 12, 1999 through Sunday, March 14, 1999, contingent upon satisfactory inspection by the Building Inspector and/or Fire Marshal. Motion carried unanimously.

L. 990222-12: Individual Amusement Licenses – Tri County Arena

MOTION: Supervisor Sprague, second Supervisor Nennig to grant individual amusement licenses to the Tri County Recreation Association for the Fox 11 Sports and Vacation Show, March 12-March 14, 1999; Antiques Showcase and Sale, March 20- March 21, 1999; and the Post-Crescent Home and Garden Show, March 26-March 28, 1999, all contingent upon satisfactory inspection by the Building Inspector and/or Fire Marshal. Motion carried unanimously.

M. 990222-13: Expenditures

MOTION: Supervisor Nennig, second Supervisor Sprague to approve the expenditures with the exception of none. Motion carried unanimously.

MOTION: Supervisor Sprague, second Supervisor Jurgensen to accept the minutes as submitted. Motion carried unanimously, with Supervisor Krueger abstaining from the Closed Minutes.

MOTION: Supervisor Sprague, second Supervisor Nennig to accept the correspondence for filing. Motion carried unanimously.

 

XI. REPORTS

A. Bob Vitas, Town Administrator

Valley Gateway Development Project

Administrator Vitas provided the Town Board with a report regarding the status of Valley Gateway Development. (See Attached) Chairman Tews and the Town Board directed Administrator Vitas to provide a copy of his report to the Town Clerk to be included in the minutes.

Office of the Commissioner of Railroad - Decision

A copy of the decision of the Commissioner of Railroads was reported on by Administrator Vitas. (See Attached)

B. Jack Lemke, Herrling/Clark – No Report

C. Carlene Sprague, Town Clerk – No Report

D. Town Board

Jeanne Krueger, Supervisor #1

Supervisor Krueger stated that her problem with meetings the Administrator is having with the City of Menasha and other municipalities is that prior to the meetings, the Town Board should be informed as to what is going to be discussed.

Supervisor Krueger congratulated Director of Finance Grace Vander Velden and the Finance Department for their GRATE award.

Regarding the Personnel Policy, Supervisor Krueger questioned when the change from 40 hours per week to 8 hours per day was made. She stated that she had a problem with the Court Manager who works 30 hours a week getting paid overtime on a weekly basis for working over 8 hours.

Administrator Vitas replied that the Court Manager is not requesting and has never requested overtime. This change was generated from the payroll department.

Supervisor Krueger stated that the tax payer is paying this bill and if overtime is going to be paid, she has grave concerns about this.

Robert Sprague, Supervisor #2 – No Report

Jerry Jurgensen, Supervisor #3

Supervisor Jurgensen stated that as a member of the Personnel Committee, they have put in a lot of time regarding these meetings. We have a salary plan in place. If we want to change this, we can. We want to keep the employees happy.

Supervisor Jurgensen agreed with Supervisor Krueger that if Administrator Vitas is talking to neighboring municipalities, the Board would like to know in advance and what it is in regards to.

Allen Nennig, Supervisor #4 – No Report

 

E. Arden Tews, Town Chairman

Chairman Tews spoke in regards to the March 1st Informational Meeting (Green Valley Ditch/Sanitary Sewer Project) at 6 p.m. There will not be minutes for this and attendance is not required, but encouraged.

F. Other Town Officials

Grace Vander Velden, Director of Finance

Director Vander Velden stated that the Finance Department has been working with Town Engineer Carl Sutter on special assessments for American Drive (East Shady Lane to Gas Road) and Shady Springs V.

George Dearborn, Director of Community Development

Director Dearborn stated that typically, his Department is more likely to have to deal with violence in the workplace.

Gaylene Nash, Assistant to the Town Administrator

Assistant Nash reported on the Town of Menasha’s Economic Profile, which was paid for by Wisconsin Electric and Power. (See Attached)

William Weiss, Police Chief

Chief Weiss informed the Board that he received notification that the Town of Menasha Police Department would receive a $53,000 joint grant with the City of Neenah for the GREAT (Gang Related Education And Training) program.
