MINUTES

Agendas with resolutions were posted at the Municipal Complex, Fire Station 40, Sanitary District No. 4, Appleton Public Library, Menasha Public Library, and Neenah Public Library.

CALL TO ORDER, PLEDGE OF ALLEGIANCE AND ROLL CALL

Town Chair Arden Tews called the regular meeting of the Town Board of Supervisors to order at 6:00 p.m. and led the Pledge of Allegiance.

II. AWARDS/PRESENTATIONS

A. Award – Lori Jencks, Completion of Inspection Certifications

Chairman Tews presented Lori Jencks with an Achievement Award. She has recently completed her 4th certification and is now qualified to be a 1 & 2 Family Deputy Building Inspector. On behalf of the Town of Menasha Board of Supervisors, I’d like to present you with this award. Congratulations Lori!

PUBLIC FORUM – NON-AGENDIZED TOWN RELATED MATTERS

DISCUSSION ITEMS

A. Railroad Horns and Whistles

Administrator Vitas stated that the Townships have no legislative power, but as the Town of Menasha has adopted Village powers, the attorneys at Herrling Clark will research to see if the Town of Menasha has more legislative control. He continued to say that we should investigate the railroad improvements when roads like Clayton and Irish Roads get re-constructed.

OLD BUSINESS

990426-10: Budget Transfer – Street/Park Dept. – Fax Machine

MOTION: Supervisor Krueger, second Supervisor Nennig to adopt the resolution and approve the budget transfer of $293.00 to buy a new fax machine. Motion carried unanimously, with Supervisor Sprague excused, and Supervisor Jurgensen abstaining.

NEW BUSINESS

A. 990712-1: Award Bid – Construction Olde Buggy Drive and Alex Court Extension

MOTION: Supervisor Nennig, second Supervisor Krueger to adopt the resolution and approve the bid award to Don Hietpas & Sons for the construction of Olde Buggy Drive and Alex Court. The low bid was $133,614.10 and an alternate bid og $54,638.40. Motion carried with 3 Yes, Krueger, Jurgensen, Nennig, Abstained (1) Chairman Tews and Supervisor Sprague excused.

B. 990712-2: Intergovernmental Agreement – STH 150 Multimodal Trail North Clayton Avenue and Spring Road Drive

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and approve the Intergovernmental Agreement for the STH 150 Multimodal Trail at 20% cost to the Town of $34,000. Motion carried unanimously, with Supervisor Sprague excused.

C. 990712-3: Intergovernmental Agreement – STH 114 Multimodal Trail (Oneida St. to City of Menasha Limits)

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and approve the Intergovernmental Agreement for the STH 114 Multimodal Trail which is funded entirely by the State. Motion carried unanimously, with Supervisor Sprague excused.

D. 990712-4: Authorization to Continue Discussions – Police Liaison Program

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and approve the continued discussions with the City of Menasha and the representative(s) of the School Board. Motion carried 3 Yes Jurgensen, Nennig, Chairman Tews and 1 No Krueger, with Supervisor Sprague excused.

E. 990712-5: Probationary Period Completion – Lori Jencks

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and approve her probationary period completion. Motion carried unanimously, with Supervisor Sprague excused.

F. 990712-6: Budget Amendment – Special Revenue Fund – per Capita Grant

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and authorize the Director of Finance to amend the 1999 Special Revenue Fund-Per Capita Grant account. Motion carried unanimously, with Supervisor Sprague excused.

G. 990712-7: Budget Transfer – Ventilation Fan, Police Department

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and approve the budget transfer of $410 to purchase and install a ventilation fan.. Motion carried unanimously, with Supervisor Sprague excused.

H. 990712-8: Budget Transfer – City Watch, Police Department

MOTION: Supervisor Krueger, second Supervisor Jurgensen to adopt the resolution and approve the budget transfer of $900 to participate in the City Watch program. Motion carried unanimously, with Supervisor Sprague excused.

I. 990712-9: Expenditures

MOTION: Supervisor Jurgensen, second Supervisor Nennig to approve the expenditures with the exception of none. Motion carried unanimously, with Supervisor Sprague excused.

VII. ORDINANCES

A. 990628-1:ORD An Ordinance Creating and Adding NEW Chapter 26 to the Town of Menasha Municipal Code – Truancy; Section 26.01 – Truancy and Habitual Truancy SECOND READING & ADOPTION

MOTION: Supervisor Krueger, second Supervisor Jurgensen to accept the second reading of the ordinance and adopt as submitted. Motion carried unanimously, with Supervisor Sprague excused.

VIII. RESIGNATIONS/APPOINTMENTS

990712-1: RES Retirement – Lt/Fire Marshal Harry Olszewski

MOTION: Supervisor Krueger, second Supervisor Nennig to adopt the resolution accepting the retirement of Lt/Fire Marshal Harry Olszewski effective January 31, 2000. Motion carried unanimously with deep regret. Supervisor Sprague excused.

990712-2:RES Resignation – Fire Fighter

MOTION: Supervisor Krueger, second Supervisor Nennig to accept the resignation of Dave Neuber as Fire Fighter. Motion carried unanimously, with Supervisor Sprague excused.

990712-3:APP Appointment – Fire Fighter

MOTION: Supervisor Krueger, second Supervisor Jurgensen to appoint Shawn Metzner as fire fighter. Motion carried unanimously with Supervisor Sprague excused.

990712-4:RES Resignation – Custodian

MOTION: Supervisor Krueger, second Supervisor Nennig to accept the resignation of Gregg Kuhlow. Motion carried unanimously, with Supervisor Sprague excused.

IX. APPROVAL OF MINUTES

MOTION: Supervisor Jurgensen, second Supervisor Nennig to accept the minutes for filing. Motion carried unanimously, with Supervisor Sprague excused and Supervisor Krueger abstaining from the May 27th minutes.

XI. REPORTS

A. Bob Vitas, Town Administrator

a) Valley Gateway Development

Administrator Vitas reviewed the present status of the Valley Gateway Development project. He stated that there will be a meeting to discuss this project. More information will be coming.

b) Citizen Satisfaction Survey

Administrator Vitas reviewed the Citizen Satisfaction Survey. It was the consensus of the Town Board to proceed with the survey and distribute it as is in the summer edition of The Bridge which should be coming out shortly.

B. Jack Lemke, Town Attorney

Attorney Lemke stated that there were a few things he was waiting for and commented that these should be taken care of in the upcoming meetings.

C. Carlene Sprague, Town Clerk – Excused

D. Town Board

Jeanne Krueger, Supervisor #1

Supervisor Krueger stated that a thank you was in order for George Dearborn for his efforts in working with Steve Dorn and The Willow. She stated that Mr. Dorn was very appreciative. Supervisor Krueger also inquired about the status of the training policy.

Administrator Vitas stated that the changes would be forthcoming in a policy change.

Robert Sprague, Supervisor #2 – Excused

Jerry Jurgensen, Supervisor #3

Supervisor Jurgensen inquired about the Green Valley Ditch project.

Administrator Vitas said that he had not completely reached all parties involved and stated that his efforts have been diligent. The attorneys for both sides have been trying to reach each other. He stated that Chairman Spanbauer still has some concerns over the impact.

Allen Nennig, Supervisor #4 – None

E. Arden Tews, Town Chairman

Chairman Tews thanked Chief Cox for the performance at the fire in the Palisades Park subdivision. A letter was sent to his attention with favorable comments for the Fire Department.

F. Other Town Officials

Myra Piergrossi, Principal Accounts Manager – The Town Board requested a resolution to increase the operating cash reserve by the cost of living adjustment, as previously suggested by the auditors

Don Cox, Fire ChiefGeorge Dearborn, Director of Community DevelopmentWilliam Weiss, Police Chief – None

MOTIONS BY SUPERVISORS

At 7:25 p.m., MOTION: Supervisor Krueger, second Supervisor Jurgensen to adjourn into closed session pursuant to 19.85(c): Considering employment, promotion, compensation or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility. Pursuant to 19.85(e) deliberating or negotiating the purchasing of public property, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. Pursuant to 19.85(2), the Town Board may reconvene into open session to act on any business discussed in closed session. Motion carried unanimously, with Supervisor Sprague excused.
