The agenda was posted at the Municipal Complex, Fire Station 40, Town of Menasha Utility District, Appleton Public Library, Menasha Public Library, and Neenah Public Library and is available on the Town of Menasha Website town-menasha.com.

    1. CALL TO ORDER, PLEDGE OF ALLEGIANCE AND ROLL CALL

President Arden Tews called the Regular Meeting of Utility District Commissioners to order at 4:30 p.m. and led the Pledge of Allegiance.

Utility District Secretary Carlene L.. Sprague noted the roll as follows:

III. DISCUSSION ITEMS

A. Parkwood Estates Development - request for reimbursement

Administrator Vitas reported on a letter that he received written on November 18th from Attorney James W. Snyder, representing Parkwood Investments, LTD. The letter involved a request for reimbursement of $92,248.48 from Sanitary District 4 for the following property owners:

Commissioner Jurgensen noted that there was one who has paid - Michael Vanden Heuvel for the amount of $5,438.00

Paula Pagel, Utility District Office Manager stated that some of these property owners are hooked up on a deferred assessment held by Sanitary District 4.

Administrator Vitas stated that previously, the Parkwood property was outside of the Sanitary District 4. Since the establishment of the Town of Menasha Utility District, these property owners are inside of the Utility District. If there are no agreements in place, the Wisconsin Administrative Code calls for property owners to connect in 12 months. There is only one property owner on Jacobsen Road connected to the Utility District at this time.

Attorney Claypool stated that we took on all assets and liabilities of the Sanitary District 4 when we established the Utility District. Attorney Claypool requested the file regarding this issue and stated that he would render a legal opinion at the next meeting. I will try and get the file from Attorney Fyfe.

President Tews stated that we should contact these people and have an informational meeting and explain how this will affect them. President Tews directed Administrator Vitas to write a letter to Attorney Snyder stating that we are looking into this and will get back to them in the near future. A. 991206-1:UD Establish 2000 Sewer Rate

MOTION: Commissioner Sprague, second Commissioner Jurgensen to adopt the resolution and approve the Year 2000 Sewer Rates. Motion carried unanimously.

  1. 991206-2:UD Intergovernmental Cooperation Agreement - Town of Menasha and City of Neenah Utility District

MOTION: Commissioner Krueger, second Commissioner Sprague to adopt the resolution and approve the Agreement with the City of Neenah Utility District. Motion carried unanimously.

C. 991206-3:UD General Engineering Agreement

MOTION: Commissioner Sprague, second Commissioner Jurgensen to adopt the resolution and approve the General Engineering Agreement between the Town of Menasha Utility District and McMahon Associates. Motion carried unanimously.

D. 991206-4:UD Expenditures

MOTION: Commissioner Sprague, second Commissioner Nennig to adopt the resolution and approve the expenditures with the exception of (None). Motion carried unanimously.

A. Utility District Meeting 11/08/99

MOTION: Commissioner Sprague, second Commissioner Nennig to approve the minutes as submitted. Motion carried unanimously.

IX. CORRESPONDENCE

A. Monthly Water Pumpage - East Side

MOTION: Commissioner Sprague, second Commissioner Krueger to approve the as correspondence as submitted. Motion carried unanimously.

X. REPORTS

A. Town Administrator

Administrator Vitas reported in regards to the status of Jeff Johnson on the Neenah Menasha Sewage Commission. A letter was written to Administrator Vitas by Attorney Daniel R. Goggin representing Neenah-Menasha Sewage Commission. (A copy is available in the minute book).

Attorney Claypool stated that we would need to proceed to circuit court for a declaratory ruling if we are going to protest their position. He asked the Commission if they want him to take the steps necessary to file.

Attorney Claypool stated that our first option is that Sanitary District 4 no longer exists.

It was the consensus of the Utility District Commission to direct Attorney Claypool to schedule a meeting with Attorney Goggin to explain the Utility District Commissioners position on this issue and to try and reach an agreement.

Chairman Tews stated that we should set a goal to have this issue resolved as soon as possible.

Administrator Vitas also reported on a meeting that took place regarding the Glenview Water Park and their need for connection to the Town of Menasha Utility District. (The report will be on file with the original minutes book). Administrator Vitas stated that 2 things need to happen.

Chief Cox stated that there is a lack of fire hydrants installed in this area, and we need to add them for safety reasons.

Much discussion ensued.

Administrator Vitas stated that we will get an estimate regarding how many property owners, are in the Town of Neenah, who are interested in connecting to the Town of Menasha Utility District.
