MINUTES

The agenda was posted at the Municipal Complex, Fire Station 40, Town of Menasha Utility District, Appleton Public Library, Menasha Public Library, and Neenah Public Library and is available on the Town of Menasha Website town-menasha.com.

I. CALL TO ORDER, PLEDGE OF ALLEGIANCE AND ROLL CALL

President Arden Tews called the Regular Meeting of Utility District Commissioners to order at 4:45 p.m. and led the Pledge of Allegiance.

Utility District Secretary Carlene L. Sprague noted the roll as follows:

The Clerk's minutes reflect that all New Business Resolutions on the agenda were incorrectly typed by the Administrative Secretary and all of the resolution numbers need to include (:UD) at the end of each number.

A. 000410-1:UD Authorize Design and Bidding for Highway 114 Sanitary Sewer Relocation

MOTION: Commissioner Jurgensen, second Commissioner Sprague to adopt the resolution and authorize the Town Engineer to design and solicit bids for the replacement of the Highway 114 Sanitary Sewer. Motion carried unanimously.

  1. 000410-2:UD Accept Sanitary Sewer and Water Main Extensions - Parkside Drive, City of Menasha

MOTION: Commissioner Jurgensen, second Commissioner Nennig to adopt the resolution and approve the request for water turn-on at Parkside Drive, City of Menasha. Motion carried unanimously.

C. 000410-3:UD Accept Sanitary Sewer and Water Main Extensions - Clover Meadows - Phase I

MOTION: Commissioner Krueger, second Commissioner Sprague to adopt the resolution and approve the request for water turn-on for Clover Meadows, Phase I. Motion carried unanimously.

D. 000410-4:UD Award Bid - 2000 Water Main Construction of Relays

MOTION: Commissioner Sprague, second Commissioner Nennig to adopt the resolution and award the 2000 Water Main Construction of Relays to Don Hietpas & Sons for the low bid of $474,563.50. A roll call vote: Krueger-Yes, Sprague-Yes, Jurgensen-Yes, Nennig-Yes, President Tews-Yes. Motion carried unanimously.

It was the consensus of the Town Board to deviate from the sequence of the Agenda and move Resolution F 000410-6:UD ahead of Resolution E 000410-5:UD.

F. 000410-6:UD A Resolution Providing for the Defeasance and Redemption of Waterworks System Mortgage Revenue Bonds, Series 1978 and Waterworks System Refunding Mortgage Revenue Bonds dated August 1, 1991.

MOTION: Commissioner Jurgensen, second Commissioner Sprague to adopt the resolution and authorize the Town Finance Director/Treasurer to execute the process necessary to accommplish the defeasance. A roll call vote: Krueger-Yes, Sprague-Yes, Jurgensen-Yes, Nennig-Yes and President Tews-Yes. Motion carried unanimously.

Item E 000410-5:UD was discussed next.

E. 000410-5:UD A resolution Authorizing the Issuance and Sale of $3,385,000 Waterworks System and Sewerage System Revenue Bonds of the Town of Menasha, Winnebago County Wisconsin, and Providing for the Payment of the Bonds and Other Details with Respect to the Bonds.

MOTION: Commissioner Jurgensen, second Commissioner Sprague to adopt the resolution and authorize the issuance and sale of $3,385,000 Waterworks System and Sewerage system Revenue Bonds for the Town of Menasha. A roll call vote: Krueger-Yes, Sprague-Yes, Jurgensen-Yes, Nennig-Yes, and President Tews-Yes. Motion carried unanimously.

G. 000410-7:UD Expenditures

MOTION: Commissioner Sprague, second Commissioner Krueger to adopt the resolution and approve the expenditures with the exception of (none). Motion carried unanimously.

VI. ORDINANCES

A. 000228-1:ORD Creating Chapter 2 of the Town of Menasha Utility District Code of Ordinances - Special Assessments ADOPTION

MOTION: Commissioner Sprague, second Commissioner Nennig to Adopt the ordinance creating Chapter 2 of the Town of Menasha Utility District Code of Ordinances on Special Assessments. Motion carried unanimously.

VII. RESIGNATIONS/ APPOINTMENTS

A. 000410-1:RES Resignation - Utility District Treasurer

MOTION: Commissioner Nennig, second Commissioner Krueger to accept the resignation of the Utility District Treasurer effective May 8, 2000. Motion carried (4-1) Krueger, Jurgensen, Nennig and President Tews-Yes, Sprague-No.

A. Sewer Billing - 2/2000

MOTION: Commissioner Sprague, second Commissioner Jurgensen to accept the correspondence for filing. Motion carried unanimously.

X. REPORTS

A. Town Administrator - None

B. Engineer

Town Engineer Carl Sutter reported to the Town Board in regards to the Golf Village Phase II project. This will be 100% assessable. The District will not absorb it.

C. Water Superintendent - None

D. Wastewater Superintendent

Wastewater Superintendent, Steve Laabs reported on the Green Valley Ditch project. Things are moving along without any hitches.

E. Commissioners

Commissioner Krueger inquired regarding the status of the Town of Neenah agreement.

Administrator Vitas stated that there is nothing presently being reviewed. The Town of Neenah has done nothing at this point.

Chairman Tews stated that we should contact the Town of Neenah again.

Office Manager, Paula Pagel stated that they have attempted this recently.

Administrator Vitas stated that we shouldn't provide service to the Town of Neenah without an agreement. Letters to residents who are being serviced by the Utility District in the Town of Neenah need to be notified.

A consensus of the Commission was made to contact the Town of Neenah regarding this issue.

Commissioner Nennig stated that he reviewed the Green Valley Ditch project and the results look very good.

Director of Community Development George Dearborn stated that he received a report from one resident who is not happy with the Green Valley project. He stated that the sump pump discharge pipe was covered up.
