Town Chair Arden Tews called the Regular Meeting of the Town Board of Supervisors to order at 6:00 p.m. and led the Pledge of Allegiance.

       Pursuant to WI State Statutes 19.83(2) and 19.84(2), the public may present matters; however, they cannot be discussed or acted upon until specific notice of the subject matter of the proposed action can be given.   


       Robert Hawthorne of 1005 N. Lake St. stated he felt his property ($412,000) was unfairly assessed.  He further stated his appraisal concerns left him frustrated.


       Resident Wm. Ottow stated for years he felt his property had been over-assessed however received good answers from town staff regarding his appraisal.


       Resident Dale Haug stated he would like the board members to show fairness.  He further stated the issue of police consolidation should be studied, storm water management implemented, more fair and honest reviews given regarding town employees and employee health insurance appraised.


       Resident Guy Hegg welcomed Supv. Jay Schroeder, stated WI ranks 51 in retirement, encouraged board members to be financially responsible and stated workers must work 90 days just to pay taxes.  He further requested the board to keep costs to a minimum and thanked the board for the controlled intersection at Old Midway/Dunning St.  He & Mr. Ottow expressed very loud motorcycle noise in their neighborhood.


       Resident Nancy McFadden stated board members were “so tight, they squeaked” and commended the town board for their fiscal responsibility regarding town taxes.


       Supv. Schroeder brought to the Town Board’s attention that board members are not following the town’s adopted Robert’s Rules of Order by allowing comments and other conversation by the audience. RROO only allows for elected board members to discuss issues unless a vote is taken for each and every speaker and given a majority approval which allows comments from the audience.  Att’y. Clark agreed with this and stated an amendment is needed giving the chairperson to deviate from RROO.



       MOTION: Tews/Handevidt to allow Martha Andrew to speak. Motion carried.


       Mrs. Andrews continued her loyalty and praise regarding Assessor Richard Eiberger.


       MOTION: Supv. Sauer/Handevidt to allow William Ottow to speak.  Motion carried.

       Mr. Ottow complained of very loud motorcycle noise in his neighborhood however stated he had no complaints on his property assessment.





       a)     040712-1: Set Public Hearing Date – Amendment to 2003 Comprehensive Plan Future Land Use Map     MOTION: Sauer/Schroeder to adopt to approve as submitted.  Motion carried.


       b)     040712-2: Budget Amendment – Police Department 

       MOTION: Jurgensen/Sauer to adopt to approve as submitted.  Motion carried.


       c)    040712-3: Sale of Used Police and Fire Vehicles

       MOTION: Handevidt/Sauer to adopt to approve. After discussion, MOTION: Handevidt/Sauer to include the sale of 2 additional used vehicles; a 2002 Crown Vic to be sold to the Town of

       Menasha Fire Dept. for $6,800 and a 1996 Crown Vic to be sold at auction for a minimum bid of $2,500.


On the amendment, motion carried unanimously.  Approval on the amended resolution, motion carried with Supv. Schroeder voting NAY.


       d)   040712-4: Expenditures

       MOTION: Handevidt/Jurgensen to adopt to approve the expenditures with the exception of (none) as submitted.  Motion carried.


       e)    040712-5: Temporary Class “B” Retailer’s License – Youth Sports Baseball/Softball, Inc.

       MOTION: Handevidt/Sauer to adopt to approve as submitted.  Motion carried.


       f)     040712-6: Annual Bar Operator License Applicants

       MOTION: Sauer/Handevidt to adopt to approve as submitted.  Motion carried.



       a)    040628-1:ORD Amending Town of Menasha Municipal Code chapter 9.01(14) Reserve

       Licenses     Second Reading

Atty. Roger Clark had been requested to give a legal opinion of returning any portion of the fee from a reserve license holder.  He advised board members that to return the reserve license fees in grant form or any other form would be circumventing state statutes.  He further stated that villages & cities were allowed TIF districts where development grants can be obtained however, towns do not have this option.  Att’y. Clark stated that after the town’s 14 regular licenses were depleted, reserve licenses allow additional licenses, however, with a $10,000 price tag plus the Class B fee. 


       MOTION: Handevidt/Jurgensen to accept the Second Reading of the ordinance choosing Option 3, to “Leave ordinance as is”.  On roll call, motion failed 3-2 with Supvs. Schroeder, Sauer & Chairman Tews voting NAY and Supvs. Jurgensen & Handevidt voting AYE.


       b)    040712-2:ORD Amending Town of Menasha Municipal Code Chapter 2.03 Order of Business   First Reading, Second Reading and Adoption                  

       MOTION: Handevidt/Jurgensen to waive the First and Second Reading and Adopt the ordinance as submitted.  Motion carried.



a)    040712-1:RESIGN  Paid-on-Call Firefighter - Norton

MOTION: Handevidt/Sauer to accept the resignation as submitted.  Motion carried.



        a)     Regular Town Board Meeting – June 28, 2004

        b)                                                            Closed Town Board Meeting – June 28, 2004

        MOTION: Handevidt/Jurgensen to approve the minutes as submitted.  Motion carried.



        a)    Fire Department Monthly Activity Report – May 2004               

        MOTION: Handevidt/Sauer to accept the correspondence for filing as submitted.  Motion carried.



        a)                                                                      Town Board

¨       Supv. Schroeder – Assessor Services: Nothing new at this time.

¨       Supv. Handevidt – Term Limits: Held report for another meeting.  


        b)   Other Town Officials

             Comm. Dev. Dir, George Dearborn – Building Activity Report:  (See Attached)

             Police Chief McCants – National Night Out Kickoff Open House:  Police Dept. will be hosting their first “Night Out Rally” Aug. 2nd from 4:00-7:30.   

          Fire Chief Kiesow – Revision of the County Hazard Mitigation Plan:  The Manitowoc Rd. area is now being included in the Hazard Mitigation Plan.  


          Parks & Rec. Dir. Mike Kading – Trestle Trail Project; Distributed handouts (See Attached) and gave project update.


          MOTION: Handevidt/Jurgensen for Nancy McFadden to speak. Motion carried.

          Ms. McFadden asked what percentage the Town had to pay toward the trestle trail project.

          Park Dir. Kading stated the Town portion would be 10% and the City portion 10%, with the balance being carried by a DOT Grant.


          Finance Dir. Myra Piergrossi – Financial Reports:  Budget update. (See handout)





At 7:39 p.m., MOTION: Handevidt/Sauer to adjourn the Regular Meeting of the Town Board of Supervisors.  Motion carried.
