RE: Agenda Item 1 – Final Subdivision Plat – Martenson & Eisele, Inc – Meadow Heights Subdivision – Proposed 109 Lot Subdivision (Preliminary Plat Approved 4/16/03)

Overview

Martenson & Eisele has submitted a 109-lot single-family and two-family subdivision plat for final approval of the Meadow Heights Subdivision located at 1631 N Clayton Ave.

The Meadow Heights preliminary plat was approved at 4/16/03 PC as well as a rezoning to R-2 Suburban Residential and R-3 Two-Family Residential. The proposed final subdivision plat proposes 16 lots will be for two-family homes, and 93 lots will be for single-family homes. Average lot size for the two-family lots is 19,210 sq ft; average lot size for the single-family lots is 12,613 sq ft. Also the developer is proposing a 6,381 sq ft toddler lot and a 49,003 sq ft outlot along USH 10 as additional right-of-way to the Town of Menasha. This proposal is consistent with Section 17.05 R-2 Suburban Residential and Section 17.06 Two-Family Residential of the Winnebago Town-County Zoning Ordinance, and is consistent with The Town of Menasha 2003 Comprehensive Plan which labels this area Low Density Residential.

Access restrictions have been placed on all lots backing on to West American Drive, all lots backing onto USH 10, and 3 lots backing on Clayton Avenue. Restrictions have also been placed for driveway access at the intersections of Hillington Drive, Dalebrook Drive and Clayton Avenue with West American Drive to reduce potential traffic accidents.

A 12’ Utility Easement has been dedicated along all right of way frontages. Two detention pond easements have been dedicated. The Wisconsin Department of Transportation granted a 34 foot special exception for Outlot #1 to their required 50’ foot setback along USH 10.

Findings of Fact

1. The applicant has not submitted the following plans for review:

i) Street Plans and profiles showing existing and proposed grades, soil conditions, elevations and cross sections of required improvements.

ii) Sanitary sewer, catchbasin, manhole plans and profiles showing the locations, grades, sizes, elevation and materials of required facilities.

iii) Storm sewer, catchbasin, manhole plans and profiles showing locations, grades, sizes, elevation and materials of required facilities.

iv) Water main, hydrant, valve, catchbasin, manhole plans and profiles showing the locations, sizes, elevations, and materials, of required facilities.

2. The following concerns were identified at the June 30, 2003 Staff Review Meeting:

Drainage and Storm Water

1. A drainage plan and fees have not been submitted for review by the Town Engineer.

Staff Recommendation

The developer stated at meeting on July 10, 2003 that they will be able to supply all the required materials to staff before July 18th, 2003. Staff therefore recommends conditional approval of the Meadow Heights final subdivision plat with the following conditions:

Development Agreement

Street Design

1. Street plans and profiles showing existing and proposed grades, soil conditions, elevations and cross sections of required improvements shall be submitted prior to the signing of the final plat.

2. Sanitary sewer, catchbasin, manhole plans and profiles showing the locations, grades, sizes, elevation and materials of required facilities shall be submitted prior to the signing of the final plat.

3. Storm sewer, catchbasin, manhole plans and profiles showing locations, grades, sizes, elevation and materials of required facilities shall be submitted prior to the signing of the final plat.

4. Water main, hydrant, valve, catchbasin, manhole plans and profiles showing the locations, sizes, elevations, and materials, of required facilities shall be submitted prior to the signing of the final plat.

Drainage and Storm Water

1. A Drainage Plan shall be submitted in accordance with Sections 6 and 15.12 of the Town of Menasha Municipal Code Book for review by the Town Engineer prior to signing of the final plat. A fee of $800.00 shall accompany said plan in accordance with Section 6.12(2).

Plat Correction

1. Setback shall be modified on lots 12-16 and 17-19 as labeled on the plan submitted on 07/10/2003 from 34 feet to 50 feet as required by the Wisconsin Department of Transportation.

Additional Approving Authorities

1. Winnebago County has separate review authority of plats and the developer shall be aware of and comply with all requirements of the County to obtain approval from the County.

2. Approval of all agencies and all other governmental entities with authority to object to a plat.
