RE:          Agenda Item 7: CSM – Martenson & Eisele, Inc. – Jacobsen Rd.

The CSM off of Jacobsen Rd. is proposing to create two new lots and dedicate a 60 ft. public road right-of-way. Lot 1 will be 12.85 acres and Lot 2 will be 1.44 acres. The street name for the 60 ft. dedicated right-of-way will be Westcreek Lane. The new street name will need to be reviewed and approved by Winnebago County in order to make sure there is no other duplication in the county.

In August 2002, the Town Bd. approved a Conditional Use Permit for a 46-unit single-family condominium project. One of the conditions required the road to be dedicated to the public. Since the R-5 zoning district required a 30 ft. setback to a public road right-of-way, the Town drafted an amendment to allow up to a zero setback. The Plan Commission and Town Bd. recommended approval of this amendment in November 2002 and the County will officially approve it later this month. In the meantime, a CSM is required in order to dedicate the road to the public and to create the lots for the condominiums. The entire road will not be constructed at this time, since the developer intends on phasing the project, and each phase will require a temporary cul-de-sac for emergency and other Town vehicles.

As a side note, the CSM indicates that the City of Neenah has a 100 ft. officially mapped right-of-way for Jacobsen Rd. when Town GIS data shows it to be an 80 ft. mapped right-of-way.

Staff Recommendation

Staff recommends approval of the CSM, with the modification that the 100 ft. officially mapped right-of-way for Jacobsen Rd is changed to 80 ft.
